These meeting minutes were approved on December 12, 2017.

A Regular Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

BOARD MEMBERS PRESENT:

Town Supervisor Charles Whitson, Jr., Deputy Supervisor D. Joseph Bates, Councilperson Donald Amell, Councilperson Jennifer Fuller, and Councilperson Dean Montroy.

A quorum of the Board was in attendance.

TOWN EMPLOYEES PRESENT:

Deputy Highway Superintendant Douglas Snickles, Water Superintendant Jeff Cotter, Town Clerk Barbara Darrah, and Town Historian Davina Winemiller.

TOWN EMPLOYEES EXCUSED:

Code Enforcement Officer Robert Hammond and Wastewater Superintendant Stanley Ingison.

GUESTS:

Sandy Hayes and Devin James were in attendance.

Notice was posted regarding the date of this meeting.

Supervisor Whitson called the Meeting to order at 6:30 p.m.

Supervisor Whitson led the Pledge of Allegiance.

HIGHWAY DEPARTMENT MONTHLY REPORT

Deputy Superintendent Douglas Snickles reported all the highway vehicles were ready for the winter season: plows and tires installed. The Highway crew has been busy cutting brush along the River Road. Douglas reported he had interviewed three individuals for the Motor Equipment Operator vacancy. One individual did not want to take a cut in pay from his current position. Another individual had their CDL license but lived in the Town of Harrietstown, and the third person seemed appropriate but needed to gain his CDL License. Douglas stated he compared costs per revenue in keeping the State Contract for maintaining Route 3, and did not see any benefit in keeping the contract. In addition, if the Highway did not have the State Contract, there would be no need to fill the vacant position at this time. Supervisor Whitson stated the Union Contract says the Town has to have three full-time employees for the next two years. Supervisor Whitson instructed Douglas to keep focused on the labor involved and how many times Trudeau Road and Rockledge are plowed this year.

WATER DEPARTMENT MONTHLY REPORT

Water Superintendant Jeff Cotter presented the following written report to the Board:

Town of St. Armand Water Report for 11/9/17 Meeting

    1. Flushing Fire Hydrants - Spent two weeks flushing fire hydrants and lubricating the hydrant stems and caps. This has taken loner [sic] than normal due to lubricating the hydrants so I still have the River Road and RT #3 hydrant to do.

    2. Installed New Reader - I installed a new reader at 18 Oregon Plains road per owners request on 10/23/17.

    3. Reprogrammed Reader - I had to reprogram the reader at 3 Blue Spruce 2 times and the reader would not hold the reprogramming. I advised Barb to let the home owner know that she needed a new meter and reader. The home owner had a plumber replace both with the old style meter and reader.

    4. Located Shut-off Curb Stop at 788 St. Regis Ave. - I dug up the curb stop and attempted to shut off the water service to prevent the home from freezing up per Charlies request. I tried to turn the curb stop off, however I don't believe that it turned off. We will need to verify from inside the house. If it did not shut off, we have to determine who will be responsible to dig up the curb stop so that the water can be shutoff for the winter if nobody will be living in the home.

    5. Monthly Coliform Samples - I submitted two monthly coliform samples from the Town Hall and Youth Center to Life Science Lab. Both samples came back negative.

    6. Reduced Well #5 Run Time - On 10/26/17, I reduced the run time to well #5 by 2 hours due to the water level in the Stand Pipe reaching the overflow. This reduced the daily water production from 54,000 gallons per day to about 45,000 gallons per day. This will save water and electricity costs.

    7. Water Leak Inside 33 Main Residence - I investigated a water leak inside the home of 33 Main St. per Charlie’s request on 11/3/17. I advised the home owner that it was his responsibility to have the pipe replaced and offered advise [sic] on what was needed. He said he would take care of the problem. It wasn't necessary to shut off the curb stop because there was a functional shutoff valve inside the home.

    8. 37 Poplar No Water Pressure - I investigated a no water pressure complaint at 37 Poplar per Barb's request on 11/6/17. I crawled under the home and discovered that the PRV appeared to be the cause of the problem. I advised the home owner on what was needed for a replacement and she was going to replace the PRV.

    9. Wet Tap On School Street - I am still waiting on a reply from the home owner of a new residence on School St. about providing a water service for him. A building permit was issued, however I have reached out to the home owner asking when he wanted me to provide the wet tap service and he has not replied. My concern is this will be difficult to do in the middle of the winter.

    10. Test Ran Generator - No issues to report.

o Notice and Order re-issued due to incorrect address.
o Hand delivered to premises.
o Date to correct and remedy these violations is 27 November 2017

• 17-SA-002: Kanze, Edward & Debbie / Witt, Scott, 80 Moose Lane, (Housing Assistance Program of Essex County) – Enforcement Action
o County has engaged a Registered Design Professional to assist with the project. Architectural & Engineering Design Associates P. C. from Plattsburgh will be the engineer of record.
o Engaged in several conversations with AEDA during the month.
o Solution pending.

• 17-SA-007PM: Reynolds, Gene, 788 St Regis – Property Maintenance Violations
o Conducted site visit on Monday the 30th.
o The residence has numerous violations that are a risk to the health and safety of the public. The residence is vacant.
o Enforcement action shall be administered.

New Building Permits and Applications

• 17-SA-036: Bordeau, Matthew 26 Matthew Way - Manufactured Homes and Buried Utilities.
o Notice of Complete Application Issued, requires Certified Installer.
o Installation shall comply with manufacturer’s installation requirements. A certified installer shall provide a Home Installation Warranty before a Certificate of Occupancy is issued.
o A third party Electrical Inspector shall be required to inspect and provide documentation for all electrical work on the Owner side of the meter.

• 17-SA-037: Filsinger, David / Apex Solar, 175 River Road – Roof Mounted Solar Panels
o Notification before Start of Work required, Applicant has complied.
o Approval of Third Party Electrical Inspection Required.

• 17-SA-038: Miller, Todd / Smith, Lisa & Craig, 773 St. Regis – Alterations to Covered Front Entrance
o Permitted after vetting of foundation system approach.

• 17-SA-039: LC Camp, LLC, aka: Camp Woodsmoke, Lake Placid – Boat House
o Project was proposed in 2010, and permitted by the Town. But with issues from the Army Corp of Engineers and the NYS Department of Environmental Conservation, the project was stopped.
o 2017 Application Review was identified as incomplete:
 Lack State Environmental Quality Review Act supporting documentation.
 Lack Jurisdictional Determination from the APA
 Twenty-Six Building Code related comments were identified to be addressed in the Application Review.

WASTEWATER DEPARTMENT MONTHLY REPORT

Wastewater Superintendent Stanley Ingison was excused but submitted the following written report to the Board:

Town of St. Armand Wastewater Department

Summary of last month’s activities for the November 2017 meeting

    1) Still having trouble getting the remote access to the SCADA system set up with the new Spectrum internet; so after talking with Aqualogics thinking we could do it remotely they are sending Bob here next week. He will be re-entering the system and bringing us replacement bulbs and covers for the front panels.

    2) The screen auger and the grit system have had no more issues over the last few weeks. I did clean out the channels again and things are operating smoothly.

    3) I have been working with Kevin to find out what is going on with the solar panel web site but he has not found out what the issue is yet. I haven’t contacted him recently but will do that soon.

    4) A week ago I did some work sealing the broken walls of man hole C3 on St. Regis Ave with hydraulic cement. I also did a new I & M plan inspection on it and found that the bench around the trough had also cracked and was washed out behind the cracks so I also cemented that making it ready for winter just in time as it went down near zero the next day.

    5) I have also done yearly inspections on other man holes and sewer mains as the DEC I & M Plan calls for and will continue to work on that for the remainder of the year.

    6) We did get a drum of polymer in to be ready for the fall turnover of the lagoons but nicely for some reason it hasn’t happened yet. We are waiting for it so we can do some testing of the more worst case effluent situation so the engineers can properly design the UV disinfection system to meet our true needs in the future.

    7) I built some shelving to organize storage a bit better and make more space in the garage along with neatening it up a bit. I started to reorganize and clean up but I still need to make a second set of shelving to complete the job.

    8) I did get the Pre-Treatment building yard cleaned up and did a final mowing before the onset of freezing and snow started. The final lagoon did freeze over before I could get the vegetation skimmed off but maybe it will warm up enough to get a little work done on it before the final freeze comes.

RESOLUTIONS #36 and #37 of 2017:

RESOLUTION #36 of 2017 - CHANGE IN WATER & SEWER RATES FOR 2018

Deputy Supervisor D. Joseph Bates, who moved its adoption, offered the following resolution:

WHEREAS, A Public Hearing was held on November 9, 2017 with regards to the 2018 Budget, and

WHEREAS, as the Town of St. Armand Water & Sewer District is currently operating on an “On-Consent” Order by the NYS DEC for our SPDES Permit, and

WHEREAS, the construction of a new Waste Water Treatment Plant is under-way, and

WHEREAS, some of the cost of this construction must be brought to the Users of the St. Armand Sewer District, and

NOW AND THEREFORE, let it be Resolved that the 2018 Water Usage Rate shall remain at $4.25 per 1,000 gallons, and the 2018 Sewer Usage Rate shall increase from $8.40 per 1,000 gallons to $8.50 per 1,000 gallons, and the 2018 Water Debt Service shall decrease from $32.00 per quarter to $26.50 per quarter, and the Sewer Debt Service shall increase from $75.00 per quarter to $85.00 per quarter. These new billing rates shall become effective during the first quarter of 2018, which includes October, November and December of 2017, as adopted in the 2018 Budget for the Town of St. Armand.

RESOLUTION #37 of 2017 - BOARD APPROVAL OF 2018 ESSEX COUNTY PROPERTY TAX RE-LEVY FOR 2017 WATER AND SEWER UNPAID BALANCES

Councilperson Donald Amell, who moved its adoption, offered the following resolution:

WHEREAS, A Resolution of the Town Board of the Town of St. Armand, authorizing the amount of the 2018 Essex County Property Tax Re-levy of all unpaid Water and Sewer balances in the Bloomingdale Water and Sewer District and Rockledge Water and Sewer Districts as of November 11, 2017 in the amount of $30,861.78 plus a 10% penalty for those current unpaid balances in the amount of $1339.35 for a grand total of $ 32,201.13.

This Resolution was duly seconded by Councilperson Dean Montroy and adopted by Roll Call vote as follows:

MOTION TO PAY MONTHLY BILLS

The payment abstracts for October were presented for the Board’s approval as follows: General Vouchers #276 - #299 in the amount of $7,075.05, Trust and Agency Voucher #6 in the amount of $2.50, Highway Vouchers #218 - #236 in the amount of $7,574.65, Highway Outside Vouchers #10 - #11 in the amount of $4,238.38, Water and Sewer Vouchers #152 - #164 in the amount of $78,889.51, Sewer Project Vouchers in the amount of $0.00. There were none., and CDBG Housing Project Voucher in the amount of $0.00. There were none.

Councilperson Jennifer Fuller made the motion to approve payment of this month’s bills; the motion was seconded by Councilperson Dean Montroy. A Roll Call Vote was as follows:

MONTHLY REPORT FROM THE SUPERVISOR

Supervisor Whitson presented the Board the Supervisor’s Monthly Report for October 2017 to the Board. Councilperson Donald Amell made the Motion to accept the Supervisor’s Monthly Report. The Motion was seconded by Deputy Supervisor D. Joseph Bates. All in favor. Motion carried.

REVIEW AND APPROVAL OF PREVIOUS MINUTES

Councilperson Jennifer Fuller made the Motion to approve the Regular Meeting Minutes of October 10, 2017 and the Special Meeting Minutes for the Budget Work Sessions held on October 4, October 11, October 18, and October 25, 2017. The Motion was seconded by Councilperson Donald Amell. All in favor. Motion carried.

TOWN CLERK MONTHLY REPORT

Town Clerk Barbara Darrah gave the following report for the month of October 2017:

Spayed/Neutered Dog Licenses: 4 spayed and 4 neutered Dog Licenses for a total of: $56.00
Unspayed/Unneutered Dog Licenses: 2 Unspayed/Unneutered Dog Licenses for a total of: $28.00
Total Revenue Earned: $84.00 Paid to Supervisor: $70.00 Paid to NYS Agriculture & Markets: $14.00

WATER & SEWER BILLING MONTHLY REPORT

Water & Sewer Clerk Barbara Darrah reported the Water & Sewer Receivables Report of 45,902.88 due for all accounts. Current Billing: $25,076.73, Over 30 days: $9,542.89, Over 60 days: $5,086.27, and Over 90 days: $6,196.99. The final water and sewer balances are due by Friday, November 10th, 2017. Due to November 10th being the County’s observed day off for Veteran’s Day, Saturday, November 11, 2017, and the Post Office being closed on November 11, 2017, in observance, payments will be accepted on Monday, November 13, 2017. Any remaining balances after November 13th will have Late fees applied and the total amounts will be submitted to Essex County on November 14, 2017, for re-levy on the 2018 Real Property Tax bill.

OLD BUSINESS

Councilperson Dean Montroy asked if the Board could discuss the Code Enforcement Officer position. Supervisor Whitson stated they would go into Executive Session at the end of the Meeting.

NEW BUSINESS

Supervisor Whitson reported to the Board that the Bloomingdale Fire Department had contacted him and spoke with Deputy Highway Superintendent Douglas Snickles about the possibility of filling the fire trucks at the Town of St. Armand Highway pumps. Supervisor Whitson explained that when the Fire Deparment [sic] moved to Franklin County dispatch, they were getting fuel from the Town of Franklin in Vermontville, but it has been difficult to do so, due to gates being locked, etc. They used to get their fuel from the Town of St. Armand and would like to go back to that routine. Councilperson Donald Amell asked how the record keeping was done for the Fire Department; how did the Town keep track of their fills. Davina Winemiller spoke up, stating they used to have to fill out a sheet with the start and end reading of the fuel pump and a bill was sent to the fire department for what they owed. Supervisor Whitson said they would have a key to activate the pumps and there were white lights that indicated which pump was activated for use. Davina Winemiller stated it ran well when they had previously done it. Councilperson Dean Montroy stated as long as it’s accounted for, that the gas slips are turned in and bills are reviewed for price changes, how much fuel was billed at and how much they used. The Board and Supervisor Whitson agreed that a Resolution would need to be done in the December meeting to approve this.

QUESTIONS

Supervisor Whitson asked those present if there were any other questions or concerns. There were none.

MOVE TO EXECUTIVE SESSION

Supervisor Whitson requested the Board move into Executive Session. Guests and the Town Clerk left the Board room. Per notation from Councilperson Jennifer Fuller, the Executive Session began at 7:41 pm. The Executive Session was closed by Supervisor Whitson at 7:54 pm.

MOTION TO REOPEN REGULAR MEETING

A Motion was made by Deputy Supervisor Joseph Bates and seconded by Councilperson Donald Amell to go back into Regular Meeting session.

MOTION TO ADJOURN

Deputy Supervisor D. Joseph Bates made the Motion to adjournthe Regular Board Meeting. The motion was seconded by Councilperson Jennifer Fuller. The Regular Board Meeting adjourned at 7:59 pm.
