These Special Board Meeting Minutes were approved on March 21, 2017.

A Special Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

BOARD MEMBERS PRESENT:

Town Supervisor Charles Whitson, Jr., Deputy Supervisor D. Joseph Bates, Councilperson Donald Amell, Councilperson Jennifer Fuller, Councilperson Dean Montroy.
A quorum of the Board was in attendance.

TOWN EMPLOYEES PRESENT:

Town Clerk Barbara Darrah.

Notice was posted regarding the date of this meeting.

Supervisor Whitson called the Meeting to order at 6:04 p.m.

Supervisor Whitson led the Pledge of Allegiance.

Supervisor Whitson read the following Public Hearing Notice:

NOTICE IS HEREBY GIVEN that the Town of St. Armand, 1702 NYS Route 3, Bloomingdale, will be conducting a Special Meeting on Friday, March 3, 2017 at 6:00 pm at the Town Hall location stated above, for the purpose of discussing union negotiations and an addendum to the Town of St. Armand Personnel Policy & Employee Benefits.

Supervisor Whitson then read proposed Resolution #23, regarding mandated Drug Testing and the consequences of having a positive result on a drug test:

RESOLUTION 23 of 2017 - ADDEMDUM TO TOWN OF ST. ARMAND PERSONNEL EMPLOYEE BENEFITS POLICY DATED MAY 12, 2015

Councilperson Dean Montroy, who moved its adoption, offered the following resolution:

WHEREAS, the Town of St. Armand’s existing Personnel Employee Benefits Policy dated May 12, 2015, contains a section entitled Physicals and Random Drug Testing and,

WHEREAS, the current policy states:

    (1) The Town of St. Armand is committed to comply with the Federal Drug-Free Workplace Act of 1988, the Omnibus Transportation Employee Testing Act of 1991, and the regulations promulgated and adopted in furtherance thereof, and,

    (2) Employees subject to the Acts as identified above shall be required to submit to all physicals and random drug testing requirements as required or provided for under such Acts and,

WHEREAS, an addendum adding the Town of St. Armand’s policy regarding disciplinary action should such random drug testing result in a positive result,

THEREFORE, from this date forward, employment with the Town of St. Armand for any employee whose random drug test is determined to have a positive result shall be terminated immediately.

Councilperson D. Joseph Bates duly seconded this resolution and it was adopted as follows:

Councilperson Donald Amell - AYE
Councilperson Jennifer Fuller - AYE
Councilperson Dean Montroy - AYE

The Board then discussed the need for a new resolution for retiring employees’ health insurance and how it would be handled from this point forward with employees contributions and the Town’s contributions. It was determined the resolution would be further discussed once the Board met with the Union representatives, town employees and Town Attorney on Tuesday, March 7, 2019.

MOTION TO ADJOURN

Deputy Supervisor D. Joseph Bates made a motion to adjourn the meeting and Councilperson Jennifer Fuller seconded the motion. All in favor. Motion carried.

The Special Meeting adjourned at 7:02 p.m.
