Meeting minutes were approved on July 14, 2015.

A Regular Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

BOARD MEMBERS PRESENT:

Town Supervisor Charles Whitson, Jr., Deputy Supervisor Sam Grimone, Councilperson Don Amell, Councilperson Jennifer Fuller, Councilperson D. Joseph Bates
A quorum of the Board was in attendance.

TOWN EMPLOYEES PRESENT:

Town Clerk Davina Thurston, Water Superintendant Jeff Cotter, Code Enforcement Officer Robert Hammond

GUEST:

Sandy Hayes, Mac Rand, Connie and Bucky Willette, Ray Tempestili

Notice was posted regarding the date of this meeting.

Supervisor Whitson called the Regular Board Meeting to order at 6:30 p.m

Councilperson Amell led the Pledge of Allegiance.

GUEST SPEAKER

Mac Rand, Director of the Saranac Lake Youth Program gave a report to the Board regarding the Summer Youth Program in Saranac Lake.

CONNIE WILLETTE RETIREMENT

Supervisor Whitson presented Connie Willette with a Certificate of Appreciation and a gift for her retirement after 42 years of service for the Town of St. Armand.

PUBLIC HEARING

At 6:45 pm, Deputy Supervisor Grimone made a motion to adjourn the Regular Board Meeting, seconded by Councilperson Bates. Discussion ensued regarding the Proposed Sewer Ordinance. At 6:50 PM, Deputy Supervisor Grimone made a motion to adjourn the Public Hearing until 7:00 PM, seconded by Councilperson Fuller.

WATER DEPARTMENT MONTHLY REPORT

Water Superintendant Jeff Cotter reviewed the his written report with the Board. This report is kept on file at the office of the Town Clerk, and is available to the Public upon request.

PUBLIC HEARING

At 7:03 pm, Deputy Supervisor Grimone made a motion to adjourn the Regular Board Meeting, seconded by Councilperson Bates. Town Clerk Davina Thurston read the following statement that was published in the Adirondack Daily Enterprise per Town Law:

    NOTICE IS HEREBY GIVEN that the St. Armand Town Board will hold a public hearing on Tuesday, June 9th, 2015 beginning at 7:00 p.m. at the Bloomingdale Town Hall, 1702 NYS Route 3, in the Town of St. Armand, concerning proposed Sewer Ordinance. The proposed Sewer Ordinance would establish regulations with regards to the disposal, transmission and treatment of waste water.

    A copy of the proposed Ordinance is on file in the Town Clerk's Office. Please call 518-891-3189 ext 3 or email: starmand@roadrunner.com to receive a copy of this Proposed Ordinance.

    PLEASE TAKE FURTHER NOTICE that all interested parties will be heard at this time and place.

Supervisor Whitson asked for comments, none were made.

At 7:08 PM, Deputy Supervisor Grimone made a motion to adjourn the Public Hearing, seconded by Councilperson Bates.

Resolution 36 of 2015 - RESOLUTION OF THE ST. ARMAND TOWN BOARD - ADOPTING THE SEWER ORDINANCE AND SPILL RESPONSE PLAN

The following Resolution was offered by Deputy Supervisor Grimone:

    WHEREAS, the Town Board wishes to consider adoption of the Proposed Sewer Ordinance and Spill Response Plan to protect the health and wellbeing of the community, and

    WHEREAS, this legislation is authorized in accordance with the Town’s police powers and by New York State Town Law Section 130; and

    WHEREAS, the Town Board scheduled a Public Hearing on this Proposed Ordinance that was held at 7:00 p.m. on June 9, 2015; and all interested parties were heard at this time, and

    WHEREAS, notice of such Public Hearing was duly posted on the official Town Bulletin Board and further published in the Town’s official newspaper, the Adirondack Daily Enterprise, in accordance with law; and

    WHEREAS, a copy of the proposed Sewer Ordinance and Spill Response Plan is kept on file at the Town Clerk’s office in the Town Hall, Bloomingdale, NY, and any individual wishing to obtain a copy of such document may do so at no cost to them, during regular business hours at the St. Armand Town Hall, and

    NOW, THEREFORE, BE IT RESOLVED, that the St. Armand Town Board hereby finds that it is in the best interest of the public health, safety and welfare to enact the proposed Sewer Ordinance and Spill Response Plan; and

    BE IT FURTHER RESOLVED, that the St. Armand Town Board hereby adopts the Sewer Ordinance and Spill Response Plan; and

    BE IT FURTHER RESOLVED, that the St. Armand Town Board hereby authorizes and directs the Town Clerk to file the Local Law with the New York Secretary of State in accordance with the provisions of the Municipal Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing by the Secretary of State.

This Resolution was seconded by Councilperson Bates and adopted by roll-call vote as follows: ALL AYE

CODE ENFORCEMENT OFFICER’S REPORT

CEO Robert Hammond gave the Board his written report. This report is kept on file at the office of the Town Clerk, and is available to the Public upon request.

Resolution 37 of 2015 – Changes & Updates to Building Permits

The following Resolution was offered by Councilperson Amell:

    WHEREAS, the Town Board acknowledges the necessity to have safe and sound building structures, and

    WHEREAS, the Town Board acknowledges that siding replacement can be a dangerous undertaking, and wishes to prevent un-insured contractors from performing siding replacement, and

    WHEREAS, the Town Board has decided to make a building permit a necessity for any siding replacement with a flat building permit fee of $25.00, and

    WHEREAS, the Town Board has approved the changes to the Building Permit Application Instructions document as drafted, and

    NOW, THEREFORE, BE IT RESOLVED, that the St. Armand Town Board hereby finds that it is in the best interest of the residents of the Town of St. Armand, to require Building Permits for all siding replacement.

This Resolution was seconded by Councilperson Fuller, and adopted by roll-call vote as follows:

MOTION TO PAY MONTHLY BILLS

Councilperson Fuller made a motion to pay this month’s bills; the motion was seconded by Deputy Supervisor Grimone. All agreed. Motion carried

REVIEW AND APPROVAL OF PREVIOUS MINUTES

Councilperson Amell made the motion to approve the minuets of the Motion to approve minutes of the Regular Board Meeting May 12, 2015, Special Board Meeting June 2, 2015. Councilperson Fuller seconded the motion. All approved. Motion carried.

MONTHLY REPORT FROM THE SUPERVISOR

Supervisor Whitson gave the Board the Supervisor’s monthly financial report. This report is kept on file and can be viewed at the Bloomingdale Town Hall, in the Town Clerk’s file. Deputy Supervisor Grimone made a motion to accept the Supervisors report; Councilperson Bates seconded the motion. All approved. Motion carried.

Discussion ensued regarding Resolution dated January 14, 1997. Tabled until next regular Board Meeting pending further information.

TOWN CLERK MONTHLY REPORT

Town Clerk Davina Thurston gave the Board her verbal monthly report. This report is kept on file in the Town Clerk’s office and is available to the Public by request. Town Clerk Thurston asked permission to amend her Historian Report, the Board agreed.

WATER & SEWER BILLING MONTHLY REPORT

Water & Sewer Clerk Davina Thurston gave the following report to the Board:
Current total outstanding revenues: $22,775.20.

NEW BUSINESS

RESOLUTION 38 of 2015 - Standard Work Day and Reporting

Councilperson Amell, who moved its adoption, offered the following resolution:

WHEREAS, A Resolution of the Town Board of the Town of St. Armand approve the Standard Work Day and Reporting figures for the New York State Retirement System.

Standard Work Day and Reporting Resolution

BE IT RESOLVED, that the Town of St. Armand hereby establishes the following standard work days for elected and appointed officials and will report the following days worked to the New York State and Local Employees’ Retirement System based on the time keeping system records or the record of activities maintained and submitted by these officials to the supervisor of this body:

I, Davina M. Thurston, Town Clerk of the governing board of the Town of St. Armand, of the State of New York, Do hereby certify that I have compared the foregoing with the original resolution passed by such board, at a legally convened meeting, and that same is a true copy thereof and the whole of such original.

I further certify that the full board consists of __5__ members, and that __5___ of such members were present at such meeting and _5___ of such members voted in favor of the resolution.

Councilperson Fuller duly seconded this resolution, and adopted by roll call vote as follows: ALL AYE

Resolution 39 of 2015 – Acceptance of Asset Management Plan, Part 1 - Infrastructure

The following Resolution was offered by Councilperson Bates:

    WHEREAS, the Town Board acknowledges the DEC Modified Order on Consent for SPDES Permit #0020991 requires the Town to have an Asset Management Plan for the St. Armand Sewer Department, and

    WHEREAS, the Town Board has set the task of completing an Asset Management Plan, Part 1 – Infrastructure to Water & Sewer Billing Clerk Davina Thurston, and

    WHEREAS, the Town Board recognizes the due date for such plan to be submitted to the DEC in Ray Brook, NY is June 30, 2015, and

    NOW, THEREFORE, BE IT RESOLVED, that the St. Armand Town Board hereby appoints Supervisor Charles Whitson, Jr. to be responsible for the final approval of the Asset Management Plan, Part 1- Infrastructure, that is due to the DEC on or before June 30, 2015

This Resolution was seconded by Councilperson Fuller and adopted by roll-call vote as follows:

TAX COLLECTORS REPORT

Supervisor Whitson gave the Board the Tax Collector’s Report. This report is kept on file in the office of the Town Clerk and is available to the Public upon request.

OLD BUSINESS

Discussion ensued regarding Rugby, Over 55 Club, Insurance, Meeting Minutes, and usage of the Town Hall by Religious Groups.

MOTION TO ADJOURN

Deputy Supervisor Grimone made a motion to adjourn, seconded by Councilpersons Bates. Supervisor Whitson adjourned the meeting at 8:50 pm.
