SPECIAL BOARD MEETING
Tuesday, Janury 23, 2018
6:30 PM

These minutes were approved on February 13, 2018.

A Special Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

BOARD MEMBERS PRESENT:

Town Supervisor Dean Montroy, Deputy Supervisor Jennifer Fuller, Councilperson Donald Amell, Councilperson D. Joseph Bates, Councilperson Samuel Grimone.
A quorum of the Board was in attendance.

TOWN EMPLOYEES PRESENT:

Town Accountant Tina Moody and Town Clerk Barbara Darrah

GUESTS:

Geniene Willette-Burman, Dean Everritt, Connie Willette, Bill Chaisson of the Adirondack Daily Enterprise.


Notice was posted regarding the date and time of this meeting.

Supervisor Montroy called the Meeting to order at 6:30 p.m.

Supervisor Samuel Grimone led the Pledge of Allegiance.

Supervisor Montroy announced the main purpose of the meeting was to be open to and allow questions from the public regarding the Town of St. Armand’s audit report by the Office of the Comptroller of New York State and the Town’s Corrective Action Plan response. Supervisor Montroy then proceeded to verbally review the report and responses. Various comments were exchanged for the purpose of clarification of certain findings and/or responses.

QUESTIONS

Councilperson Grimone asked if the Board needed to do a summary response as indicated in the directions in October. Town Clerk Barbara Darrah explained that she had contacted the head auditor out of the Plattsburgh Office, Kevin, who stated we had done everything necessary in our response, the Town Board members had approved our response, and placing a Public notice in our official newspaper that the audit was available in the Town Clerk’s Office for review was all we needed to do.

Town Accountant Tina Moody explained the “B” Fund and the accounts handled through that fund: Code Enforcement Officer, Vital Registrar and Health Officer. She also explained how the highway salaries needed to be taken out of the correct account, not just the General Fund, but also broken down if work was done in the Village of Saranac Lake portion of the Town of St. Armand.

Councilperson Grimone then asked about the auditor’s recommendation to seek advisement from the town’s attorney in the matter of determining if certain customer accounts were due any refunds. Supervisor Montroy reported that he did speak with the Town’s attorney regarding this issue and is waiting to hear back from him.

RESOLUTIONS # 17 - # 19 of 2018:

RESOLUTION # 17 OF 2018 - TOWN OF ST. ARMAND AUTHORIZATION FOR SIGNATURES FOR JUSTICE ACCOUNT HELD AT NBT BANK

WHEREAS, The Town of St. Armand Justice checking account is held with NBT Bank, 209 Lake Flower Avenue, Saranac Lake, NY, and

WHEREAS, the Town Justice Sheridan Swinyer has retired effective December 31, 2017, and

WHEREAS, the newly elected Town Justice, Arthur Jay Niederbuhl was sworn in effective December 7, 2017,

THEREFORE, BE IT RESOLVED, that the Town Board acknowledges and hereby authorizes Arthur Jay Niederbuhl, Town Justice, to have signature authorization for the Justice checking accounts at NBT BANK effective immediately,

AND BE IT FURTHER RESOLVED, Councilperson[sic]Jennifer Fuller, is designated to have secondary signature authorization when required.

This Resolution was duly seconded by Councilperson D. Joseph Bates and adopted by Roll Call vote as follows:

RESOLUTION # 18 of 2018 – REVISED 2018 AGREEMENT BETWEEN THE TOWN OF ST. ARMAND AND THE SARANAC LAKE VOLUNTEER RESCUE SQUARD, INC

Councilperson Donald Amell, who moved its adoption, offered the following Resolution:

WHEREAS, a Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Dean Montroy to execute the Agreement with Saranac Lake Volunteer Rescue Squad, where previously stated Charles Whitson, Jr., in Resolution #43 of 2017, and

WHEREAS the Saranac Lake Volunteer Rescue Squad provides the services of medical care and transportation via ambulance for injured and sick individuals within the borders of the Town of St. Armand, and

WHEREAS the Town Board for the Town of St. Armand agrees to the provisions set within the Agreement between the Town of St. Armand and the Saranac Lake Volunteer Rescue Squad, Inc., and the Town agrees to pay an amount of $27,849.00 for such services from January 1, 2018 to December 31, 2018, revised from the previous amount of $28,270.00 stated in Resolution 43 of 2017.

NOW THEREFORE, LET IT BE RESOLVED that the Town Board of the Town of St. Armand shall abide by the Agreement between the Town of St. Armand and the Saranac Lake Volunteer Rescue Squad, Inc.

RESOLUTION # 19 OF 2018 – 2018 CONTRACT BETWEEN THE TOWN OF ST. ARMAND AND THE TRI-LAKES HUMANE SOCIETY

Deputy Supervisor Jennifer Fuller, who moved its adoption, offered the following Resolution:

WHEREAS A Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Dean Montroy to sign the contract with Tri-Lakes Humane Society for the year 2018, and

WHEREAS the Tri-Lakes Humane Society will be the duly authorized agent for domestic animal control in the Town of St. Armand, and

WHEREAS the Town of St. Armand agrees to pay the amount of $3,090.00 for the year of 2018 for such services,

NOW THEREFORE, LET IT BE RESOLVED that the Town Board for the Town of St. Armand agrees to the current adoption fees and other rules and regulations of Tri-Lakes Human Society with regard to domestic animal control.

QUESTIONS

Guest Dean Everritt asked when the Work Session on Water and Sewer Regulations would be scheduled. Supervisor Montroy stated a date would be determined at our next regular board meeting in February. He also reported he had talked to several other town supervisors and they will be emailing their regulations to him for review.

MOTION TO MOVE INTO EXECUTIVE SESSION

Councilperson D. Joseph Bates made the Motion to enter Executive Session at 8:47 p.m. for the purpose of discussing litigation. The Board went into Executive Session at 8:48 pm. Councilperson D. Joseph Bates made the Motion to Adjourn the Executive Session at 9:15 pm. The Motion was seconded by Councilperson Donald Amell. The Board returned to the Special Board Meeting at 9:15 pm.
