A Public Hearing regarding the 2015 Fire Contract, a Public Hearing regarding the Time Warner Cable Franchise Agreement and a Regular Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

Deputy Supervisor Grimone called the meeting to order at 6:30 p.m.

Councilperson Amell led the Pledge of Allegiance.

PUBLIC HEARING - 2015 FIRE CONTRACT:

Town Clerk Davina Thurston read the following statement that had been previously published in the Adirondack Daily Enterprise:

NOTICE IS HEREBY GIVEN that the St. Armand Town Board will hold a Public Hearing on Tuesday, December 9th, beginning at 6:30 p.m. at the St. Armand Town Hall, 1702 NYS Route 3, in the Town of St. Armand, concerning the 2015 Fire Contracts, immediately following this Public Hearing will be an additional Public Hearing regarding the Time Warner Cable Franchise Agreement. Immediately following this Public Hearing, the Regular Monthly Board Meeting will take place.

Resolution 54 of 2014 - 2015 Fire Contract with Village of Saranac Lake

Councilperson Amell, who moved its adoption, offered the following resolution.

WHEREAS A Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Charles Whitson, Jr. to sign the 2015 Fire Contract with the Village of Saranac Lake, and

WHEREAS the Village has provided the services of the Village of Saranac Lake Fire Department for fire protection and rescue services pursuant to General Municipal Law Section 209-b and fire police protection pursuant to General Municipal Law Section 209-c to the Town, and

WHEREAS the Town Board for the Town of St. Armand agrees to the provisions set within the Fire Contract Agreement for 2015,

NOW THEREFORE, LET IT BE RESOLVED that the Town Board for the Town of St. Armand shall abide by the Fire Contract Agreement for 2015.

This Resolution was duly seconded by Councilperson Fuller and adopted by roll call vote as follows:

PUBLIC HEARING - TIME WARNER CABLE FRANCHISE AGREEMENT:

Deputy Supervisor Grimone asked for any comments from the Board or the Public. No one commented.

Resolution 55 of 2014 - Time Warner Cable Franchise Agreement

Councilperson Bates, who moved its adoption, offered the following resolution:

WHEREAS A Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Charles Whitson, Jr. to sign the Agreement with Time Warner Cable Northeast LLC d/b/a Time Warner Cable, and

WHEREAS the Agreement gives Time Warner Cable the right to construct and operate a television system and provide cable services, and

WHEREAS the Town Board for the Town of St. Armand agrees to the provisions set within Agreement between the Town of St. Armand and Time Warner Cable, and the Franchise Agreement complies with the standards of the New York State Public Service Commission, and

NOW THEREFORE, LET IT BE RESOLVED that the Town Board for the Town of St. Armand shall abide by the Franchise Agreement between the Town of St. Armand and Time Warner Cable.

Deputy Supervisor Grimone closed the Public Hearing for the Time Warner Cable Franchise Agreement at 6:37 PM.

REGULAR BOARD MEETING

WATER DEPARTMENT MONTHLY REPORT

Water Superintendant Jeff Cotter reviewed the following written report with the Board:

Town of St. Armand Water Report 12/9/14
•Received the NYSDH annual inspection report. The report is attached to this monthly report. It's a good report with the only major recommendation being the scheduling to replace water main valve bolts due to their failures.
•11/20/14 - We had a fire in Bloomingdale and just after the fire was extinguished we had a water main break on the corner of Prospect and Main Street. Due to the location of the leak there was no way to re-route the water and the entire Town had to be shut off. I called Fuller's to assist with the repairs. The leak turned out to be another valve problem with the bolts failing due to corrosion and poor quality steel. We replaced the bolts, repaired the valve and a boil water order was issued by us until the lab tests confirmed negative coliform tests on 11/25/14.
•I've been seeing about a 5000 gallon increase in water consumption (per day) for the Town since cold weather started and I suspect it's from some residences who are not metered are running their water to prevent their lines from freezing. History for the past few years' winter water consumption is consistently high during cold months.
•Monthly routine coliform test came back negative.
•Test ran both emergency generators.
•12/4/14 - Somebody ran into and snapped off a fire hydrant on School Street. I spent 17 working hours on rebuilding and replacing the hydrant. The hydrant is now back in service. I am working on a time and material bill for the cost of the repair.

Discussion ensued regarding the above report. Water & Sewer Clerk Davina Thurston stated that the NY Alert system was utilized for the first time for the water main break on 11/20/14. The system worked well and we received many good comments on it.

HIGHWAY SUPERINTENDANT MONTHLY REPORT

Highway Superintendant Roger Oliver was excused as he was plowing during the snow storm that was occurring during the meeting. Roger gave the Board the following written report:

Town of St. Armand Highway Report 12/8/14
•Roger and Doug will be going to Vermont Tuesday the 16th to go over the new truck and show them where we would like the controls located.
•We would like to keep the one stall in the pole barn heated at 40 degrees so we can put the Kubota tractor and the water truck and our cold patch in that one stall when the new truck gets here. We cut 16 feet off the new building and that one stall would have held the case tractor, the Kubota tractor and the water truck.
•We have had a bad stretch of luck; the loader needed two hoses replaced and oil. The Mack needed all new tires but that was the first set put on and that truck is an '09. Then the transmission coolant line rusted and had to be replaced. After all that the drive belt broke and we had to pull the front pump and the pump shaft out to replace the belt; that alone took Roger, Keith and Bob over 10 hours and we had the replace hoses on the Tandem.
•We are still setting up the garage. We are having small problems with some doors, windows and one furnace.
•Tim found an oil leak in the oil pan of the '04 International that has to be replaced. The '04 has over 100,000 miles.

Discussion ensued regarding the above report. The Board asked for an estimate to insulate the bay in the Pole Barn. Dean Montroy stated that there is condensation on the inside walls. It was decided that the air exchanger for the Garage may need to be adjusted.

WATER AND SEWER DEPT SERVICES

Deputy Supervisor Grimone discussed the under-billing error that was made. Eight property owners were under billed on debt services for 7 quarters. Deputy Grimone gave the floor to Dean Montroy, who stated that he understood that it was an error, and he did not have a problem paying for his share, but he feels that the Water and Sewer Debt Services are not being billed correctly. Lengthy discussion ensued and comments were also made by Arlene McCalvin and Tracy Kratts Jones regarding what they feel is unfair billing practices. It was decided that Water and Sewer Clerk Davina Thurston would gather pertinent data and will provide copies to everyone, and further discussion would ensue regarding future debt service billing amounts at the January 13th Board Meeting.

MONTHLY REPORT FROM THE SUPERVISOR

Deputy Supervisor Grimone gave the Board the Supervisor's monthly financial report. This report is kept on file and can be viewed at the Bloomingdale Town Hall, in the Town Clerk's file. Councilperson Amell made a motion to accept the Supervisors report; Councilperson's Bates and Fuller seconded the motion. All approved. Motion carried.

SARANAC LAKE VOLUNTEER RESCUE SQUAD

Resolution 56 of 2014 - Agreement with Saranac Lake Volunteer Rescue Squad, Inc.

Deputy Supervisor Grimone, who moved its adoption, offered the following resolution:

WHEREAS A Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Charles Whitson, Jr. to sign the Agreement with Saranac Lake Volunteer Rescue Squad, and

WHEREAS the Saranac Lake Volunteer Rescue Squad has provided the services of medical care and transportation via ambulance for injured and sick individuals within the borders of the Town of St. Armand, and

WHEREAS the Town Board for the Town of St. Armand agrees to the provisions set within Agreement between the Town of St. Armand and the Saranac Lake Volunteer Rescue Squad, Inc., and the Town agrees to pay an amount of $27,973.00 for such services, and

NOW THEREFORE, LET IT BE RESOLVED that the Town Board for the Town of St. Armand shall abide by the Agreement between the Town of St. Armand and the Saranac Lake Volunteer Rescue Squad, Inc.

This Resolution was duly seconded by Fuller and adopted by roll call vote as follows: ALL AYE

AMA FIRE CONTRACT

Supervisor Whitson informed the Board that an agreement has been reached with AMA with regards to the Fire Contract and that a bill has been sent out to them.

SNOW AND ICE CONTRACT

RESOLUTION 57 of 2014 - 2016-2017 AGREEMENT TO EXTEND FIXED LUMP SUM MUNICIPAL SNOW AND ICE AGREEMENT CONTRACT.

The following resolution was offered by Deputy Supervisor Grimone:

WHEREAS; A Resolution of the Town Board of the Town of St. Armand authorizing Supervisor Charles Whitson, Jr. to execute and sign the Snow and Ice Extension Agreement Contract for the season beginning July 1, 2016 to June 30, 2017 for the Essex County roads in the Town of St. Armand, and

WHEREAS; The Fixed Lump Sum Snow and Ice Agreement between New York State Department of Transportation (Commissioner) and St. Armand (Municipality) is hereby extended for a period of one year, expiring on June 30, 2017, and

WHEREAS; The State Highways or parts thereof affected by this Agreement are as delineated on the attached map, agreed upon by the Commissioner and the Municipality, which shall be effective for the remainder of the term of the Agreement, commencing July 1, 2016, unless changed by future agreement between the Commissioner and the Municipality, and

WHEREAS; all the terms and conditions of the original contract remain in effect, except as follows: The lump sum payment Agreement shall be $10,953.53 per lane mile for 14.6 miles for a total of $159,921.51, for the 2014-2015 season and for the remainder of the term of the Agreement commencing July 1, 2014, unless changed by future update.

This Resolution was duly seconded by Councilman Bates, and adopted by roll-call vote as follows: All Aye

CODE ENFORCEMENT REPORT

CEO Robert Drosdowich was excused from the meeting. Supervisor Whitson informed the Board that Robert has agreed to stay on until the end of March. Discussion ensued regarding the advertisement for the position of CEO and the Job Description. Minor changes were made to the ad and the Job Description. It was decided to receive applications for the CEO position until January 31, 2015.

MOTION TO PAY MONTHLY BILLS

Councilperson Amell asked Supervisor Whitson about the lawsuit that had been filed against St. Armand. Supervisor Whitson informed the Board that the suit was brought by a Rugby player who was injured last year.

Councilperson Bates made a motion to pay this month's bills; the motion was seconded by Deputy Supervisor Grimone. All agreed. Motion carried

REVIEW AND APPROVAL OF PREVIOUS MINUTES

The minuets for November 18, 2014 meeting were discussed and one change was made. Councilperson Amell made the motion to approve the minuets, seconded by Councilperson Full. All approved. Motion carried.

TOWN CLERK MONTHLY REPORT

Town Clerk Davina Thurston gave the following report for the month of July 2014:

Town Clerk Davina Thurston informed the Board that National Grid would install an electrical outlet on the pole next to Veterans' Memorial Park for free, and the Town would only be charged $58.65 per year plus usage billed once per year on the outlet. Davina asked the Board for permission to install the outlet; for approximately $100.00 per year the Town could have Christmas lights on the gazebo, trees and sign. Discussion ensued. The Board denied the request. Davina stated that she respectfully feels that the Board is making an error in this matter.

WATER & SEWER BILLING MONTHLY REPORT

Water & Sewer Clerk Davina Thurston gave the following report to the Board:

Total Outstanding Revenues:$8,347.56

The next meter reading will take place the end of December, the bills for the first quarter of 2015 will go out during the first week of January and they will be due the second week of February.

REVIEW AND UPDATE OF SEWER PROJECT

Supervisor Whitson informed the Board that progress is being made on the building and reed beds.

NEW BUSINESS

Resolution 58 of 2014 - Appreciation for the service of Leland Flint

This resolution was offered by Supervisor Charles Whitson, Jr., who moved its adoption:

WHEREAS, effective government depends upon those individuals who dedicate their time and effort to Public Service; and

WHEREAS, it is always a privilege to honor an individual who possesses the rare characteristics of honesty and commitment to the public good, and who is willing to devote their time and energy to the conduct of assisting members of their community; and

WHEREAS, Leland Flint is such an individual; and

WHEREAS, Leland Flint has ably served the Town of St. Armand as Transfer Station Attendant from April 15, 2006 until July 20, 2014, and

WHEREAS, Leland Flint has been considerate of the needs of the residents of St. Armand, and has supplied countless hours of service to his community, and

NOW, THEREFORE, LET IT BE RESOLVED, that the Board of the Town of St. Armand, hereby extends its sincere gratitude and appreciation, on behalf of the Constituents of the Town of St. Armand, to Leland Flint.

This Resolution was duly seconded by all Councilmember's and adopted as follows: All Aye

Resolution 59 of 2014 - Tri-Lakes Humane Society

Councilperson Amell, who moved its adoption, offered the following resolution:

WHEREAS A Resolution of the Town Board of the Town of St. Armand, authorizing Town Supervisor Charles Whitson, Jr. to sign the contract with Tri-Lakes Humane Society for the year 2015, and

WHEREAS Tri-Lakes Human Society will be the duly authorized agent for domestic animal control in the Town of St. Armand, and

WHEREAS the Town of St. Armand agrees to pay the amount of $3,030.00 for the year of 2015 for such services,

NOW THEREFORE, LET IT BE RESOLVED that the Town Board for the Town of St. Armand agrees to the current adoption fees and other rules and regulations of Tri-Lakes Human Society with regard to domestic animal control.

This Resolution was duly seconded by Councilperson Fuller and adopted by roll-call vote as follows: All Aye

OLD BUSINESS

Discussion ensued regarding the Local Laws. It was decided to hold a Special Board Meeting on January 20, 2015 at 6:30 PM to review the Local Laws.

Discussion ensued regarding Water and Sewer Debt Service rates. It was decided that Davina would gather data from the program and present the findings at the Regular Board Meeting on January 13, 2015.

Discussion ensued regarding the changes to the Rules and Regulations for Brookside Cemetery. It was decided that this would be further discussed at a Special Board Meeting on January 20th, 2015 at 6:30 pm with the Local Law discussion to immediately follow.

MOTION TO ADJOURN

Deputy Supervisor Grimone made a motion to adjourn, seconded by Councilpersons Bates. Supervisor Whitson adjourned the meeting at 8:42 pm.
